Pool Safety Certificates in Bundaberg

The Form 23: what it is, when Queensland law requires it, and how to get one without drama.

Who needs one, and when

  • Landlords. A current certificate is required before entering a new lease on a property with a regulated pool or spa. That includes houses, units and short-stay accommodation.
  • Sellers. Provide a current certificate at sale, or give the buyer a formal Notice of no pool safety certificate (Form 36), after which the buyer must obtain one within 90 days of settlement. Many Bundaberg sellers simply get the certificate, because it removes a negotiation lever from the buyer and a compliance risk from the contract.
  • Bodies corporate. Shared pools in unit complexes need a certificate every year.
  • Airbnb and holiday-let hosts. Short-term letting counts, and with Bargara's holiday rental market this is one of the most common certificate jobs on the coast.

Validity and the register

A pool safety certificate is valid for two years on a non-shared pool (your standard backyard pool) and one year on shared pools. Separately, every regulated pool in Queensland must appear on the state pool safety register. It's a quick check your inspector can do on the spot, and fix if the pool was never registered.

What the inspection covers

The inspector assesses your pool barrier against the Queensland pool safety standard. In practice that means barrier height and gaps, gate self-closing and self-latching from any position, latch height, hinge placement, the 900 mm non-climbable zone (pot plants, furniture and BBQs near the fence all count), fence condition, window and door restrictions where a building forms part of the barrier, and compliant CPR signage.

If it doesn't pass first time

No certificate is issued until the barrier complies. That's the law, and it's also the point. What you get instead is a specific written list of what failed and why, and almost all of it is minor: gate tension, a latch shield, a relocated pot plant, new signage. Fix, re-inspect, certificate. If you'd rather catch those items before the formal inspection, book a pre-check walkthrough.

Fines for an uncertified pool at lease or sale, or an unregistered pool, run into the thousands. Against that, the certificate is cheap insurance.
